These Terms & Conditions (“Terms”) govern the use of balancedlogisticsnc.com and the transportation services provided by Balanced Logistics (“Company,” “we,” “our,” or “us”).

By using our website or engaging our services, you agree to these Terms.

Website Use

The content on this website is provided for informational purposes only.

 

Nothing on this website constitutes a binding transportation agreement. Freight services are only confirmed through written rate confirmations, service agreements, or dispatch confirmations.

 

Balanced Logistics reserves the right to modify website content at any time without notice.

Transportation Services

All freight services are subject to:

  • Written rate confirmation

  • Equipment availability

  • Operational safety review

  • Regulatory compliance

  • Applicable federal and state laws

 

Freight will not be accepted without confirmed dispatch and agreed-upon terms.

Freight Acceptance & Load Requirements

Shipper or broker agrees to provide accurate information regarding:

​

  • Weight

  • Dimensions

  • Commodity type

  • Securement requirements

  • Pickup and delivery instructions

 

Balanced Logistics reserves the right to refuse freight that:

​

  • Exceeds equipment capacity

  • Is improperly packaged

  • Violates DOT or FMCSA regulations

  • Presents a safety hazard

 

If load details are inaccurate, additional charges may apply.

Rates & Payment Terms

All transportation rates must be agreed upon in writing prior to dispatch.

 

Unless otherwise agreed:

  • Payment terms are Net 30 days

  • Invoices not paid within agreed terms may be subject to late fees

  • Collection costs, including reasonable attorney fees, may be recovered if necessary

 

Accessorial charges may include but are not limited to:

​

  • Detention

  • Layover

  • TONU (Truck Ordered Not Used)

  • Reconsignment

  • Overweight adjustments

  • Additional securement

Detention & Layover

Unless otherwise specified:

​

  • Detention begins after 2 hours of scheduled appointment time

  • Detention rate: $75 per hour

  • Layover rate: $150 per day

 

Rates must be agreed upon in writing.

Cargo Liability

Balanced Logistics maintains commercial auto and cargo insurance as required by federal regulations.

 

Cargo claims must:

​

  • Be submitted in writing

  • Include supporting documentation

  • Be filed within applicable legal timeframes

 

Liability is limited to the lesser of:

​

  • The declared value of the freight

  • The value listed on the rate confirmation

  • The limits of cargo insurance coverage

 

Balanced Logistics is not responsible for:

​

  • Improper packaging

  • Shipper-loaded freight (SL&C)

  • Concealed damage

  • Force majeure events

Force Majeure

Balanced Logistics shall not be liable for delays or failure to perform due to events beyond reasonable control, including but not limited to:

​

  • Weather conditions

  • Natural disasters

  • Traffic accidents

  • Road closures

  • Government actions

  • Labor disputes

Shipment Tracking

Tracking information may be provided through third-party telematics systems.

 

Tracking data is provided for convenience only and does not constitute a guaranteed arrival time.

​

Estimated arrival times are approximate.

Limitation of Liability

In no event shall Balanced Logistics be liable for:

​

  • Indirect damages

  • Consequential damages

  • Lost profits

  • Business interruption

 

Total liability shall not exceed applicable cargo coverage limits or agreed contract terms.

Indemnification

Shipper or broker agrees to indemnify and hold harmless Balanced Logistics from claims arising from:

​

  • Inaccurate shipment information

  • Improper packaging

  • Regulatory violations caused by shipper instructions

  • Hazardous material misclassification

Compliance

Balanced Logistics operates in compliance with:

​

  • FMCSA regulations

  • DOT safety requirements

  • Hours-of-Service laws

  • Applicable state and federal transportation laws

Governing Law

These Terms shall be governed by the laws of the State of North Carolina.

​

Any disputes shall be resolved in the appropriate courts within North Carolina unless otherwise agreed in writing.

Changes to Terms

Balanced Logistics reserves the right to modify these Terms at any time. Updates will be posted with a revised effective date.
